Some content — such as questions from the UBQ (Ultimate Bank of Questions) — may include third-party contributions, open-licensed materials, or user-submitted content. These may be used under license, fair use, or public domain guidelines. We do not claim ownership over these third-party materials.
II. ELIGIBILITY, ACCOUNTS, AND MINORS
Eligibility
Nerd Notes is intended for users aged 13 and older. We do not knowingly allow children under 13 to create accounts or submit personal information without verifiable parental consent. If we learn we have collected such information without the required consent, we will delete it.
Users Under 18
If you are under 18 (or under the age of majority in your jurisdiction), you may use Nerd Notes only under the supervision of, and with the consent of, a parent or legal guardian who agrees to be bound by these Terms on your behalf. By using the service, you represent that you are at least 18, or that you have obtained such permission. Parents and legal guardians are responsible for their minor’s use of the service and for any charges incurred through the minor’s account.
Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

Third-Party and Google Services
Some features let you connect third-party accounts, including signing in with Google or granting access to Google services such as Google Calendar. Your use of those features is also subject to the applicable third party’s terms (including Google’s Terms of Service). Our handling of any data obtained through Google APIs is governed by our
Privacy Policy and adheres to the Google API Services User Data Policy, including the Limited Use requirements.
User-Generated Content
If you post, upload, or transmit any content to Nerd Notes (such as homework images, questions, or forum posts), you retain ownership of that content. You grant us a limited, non-exclusive, royalty-free license to host, store, display, and process that content solely as necessary to operate and provide the service to you.
We will not use your submitted content for advertising or public promotional purposes without your separate, explicit consent (or, for users under 18, the consent of a parent or guardian). This license ends when you delete the content or your account, except for backup copies retained for a reasonable period or records we are required to keep by law.
We are not responsible for the accuracy or legality of user submissions. We reserve the right to moderate or remove any content at our sole discretion.
IV. DISCLAIMER OF WARRANTIES
YOUR USE OF THE SITE AND ANY SERVICES OR PRODUCTS IS AT YOUR OWN RISK. EVERYTHING IS PROVIDED “AS IS” AND “AS AVAILABLE.”
We disclaim all warranties, express or implied, including:

VIII. SCHOOL AND INSTITUTIONAL USE
These Terms govern individual users who sign up directly with Nerd Notes. If you access Nerd Notes through a school, district, or other institution — for example, where the institution creates, assigns, or manages student accounts on its students’ behalf — that use is governed by a separate agreement between Nerd Notes and the institution, and not by these consumer Terms.
In that arrangement, Nerd Notes acts as a service provider processing student data on the institution’s behalf and in accordance with applicable law (such as FERPA and COPPA). Schools, districts, or institutions that wish to enroll students or that require a Data Processing Agreement (DPA) may email a copy of their DPA to us, or request ours, at
nerdnotes.business@gmail.com, and we will work with you to complete it before processing student data on your behalf.

X. AGREEMENT TO BE BOUND
By accessing the website, using our services, or purchasing any product, you acknowledge and agree to abide by these Terms of Service.
XI. GENERAL TERMS
Jurisdiction
This agreement is governed by the laws of the State of California, USA. All disputes shall be resolved in the courts of Alameda County, California.
Force Majeure
We are not liable for delays or failures caused by events beyond our control, including but not limited to natural disasters, cyberattacks, internet outages, or war.
Severability
If any part of these Terms is found to be unenforceable, the rest shall remain in effect.
Entire Agreement
These Terms represent the complete agreement between you and Nerd Notes. They supersede any prior agreements or understandings.
Waiver of Class Action Rights
By using this website, you waive any right to bring claims against us as part of a class action. All claims must be brought individually.
Limitation Period
Any claim against Nerd Notes must be filed within one (1) year of the event giving rise to the claim, or it is permanently barred.
Termination
We reserve the right to terminate your access if you breach these Terms. This may include canceling access to products or services without refund.
